EPISODE 110 - Criminal Pigs - The Perplexing History of Animal Trials

The idea of animals being put on trial may sound absurd today, but it was a surprisingly common practice in medieval and early modern Europe. These trials, documented as far back as the 13th century, involved animals being formally prosecuted in court for crimes such as theft, assault, or even murder. Both domestic and wild animals—including pigs, rats, dogs, and insects—were held accountable under human laws.
The process often mirrored human trials, with animals being assigned legal representation. Lawyers would argue for their defense, and witnesses might testify to the crime. For example, pigs were frequently tried for attacking humans, as they often roamed freely in villages. One notable case occurred in 1386 in Falaise, France, where a sow was dressed in human clothing and publicly executed for killing a child.
Some trials even extended to plagues of pests, like locusts or rats, with towns seeking divine intervention or legal remedies to rid themselves of infestations. In such cases, the animals were sometimes excommunicated or cursed by church officials.
These trials were not just superstitious theatrics but reflected the worldview of the time, where animals were seen as part of a moral and legal order under God. They also served as public spectacles, reinforcing social norms and justice systems. Over time, the practice faded as legal systems and societal perspectives evolved. Today, these trials are often seen as a fascinating, if bizarre, chapter in human history, highlighting the complex relationship between humans, animals, and the law.
